Terms & Conditions

All goods remain the sole property of Peter Lewis Paints Pty Ltd until all monies payable have been received in full. Prices are subject to change without notice.

Orders & Product Availability

All orders are subject to availability. We reserve the right to refuse or cancel any order where there is a material error in the description of goods, pricing, or any other published information.

Products may be modified, discontinued, added, removed, or substituted without notice. This includes changes relating to colours, finishes, formulations, and product ranges.

Colour Variations & Natural Pigments

While every effort is made to ensure colour consistency between batches, the natural characteristics of our plant-based paints, mineral paints, lime washes, and natural pigments may result in slight colour variations. These variations are normal and form part of the unique nature of our products.

Colours may also change over time due to natural ageing, environmental conditions, surface preparation, application methods, and exposure to light and weather.

Customers should inspect all colours before application. Any colour discrepancies must be reported prior to use of the product.

Although every effort is made to accurately represent colours on our website, printed materials, and promotional images, colours may appear differently depending on screen settings, lighting conditions, and printing processes. We strongly recommend purchasing a sample pot in the desired colour and finish before placing a larger order. Peter Lewis Paints Pty Ltd cannot guarantee that colours viewed on a monitor or device will accurately match the finished product.

Paint Shelf Life & Storage

Our No VOC paints are manufactured using premium natural ingredients and are designed to maintain their quality when stored correctly.

·      Unopened containers: Up to 12 months from the date of manufacture when stored in a cool, dry location away from direct sunlight and extreme temperatures.

·      Opened containers: Up to 6 months after opening, provided the container is tightly sealed immediately after use and no contaminants (including water, dirt, dust, brushes, rollers, or other foreign materials) are introduced into the paint.

Improper storage, contamination, freezing, overheating, or prolonged exposure to air may significantly reduce the product's shelf life and performance.

Peter Lewis Paints Pty Ltd accepts no responsibility for losses, damages, or costs arising from unsuitable or unsafe storage conditions.

Returns, Deposits & Consumer Rights

Australian customers have rights under the Australian Consumer Law (ACL). Nothing in these Terms & Conditions excludes, restricts, or modifies any rights or remedies available under the ACL.

As our paints are mixed to order, we are unable to accept returns for custom-mixed colours unless the product is found to be faulty.

Standard products, including preparation and ancillary products, may be returned in accordance with Australian Consumer Law and our returns policy. Customers wishing to make a return should contact us via email or telephone.

Goods manufactured, ordered, or mixed to a customer's specifications are considered personalised products and are generally excluded from cancellation rights, except where required by law.

Wallpaper & Flooring Orders

All deposits paid for wallpaper and flooring orders are strictly non-refundable. Wallpaper and flooring products are typically ordered specifically for each customer and may be custom-made, cut, printed, sourced, or reserved on the customer's behalf. Once an order has been confirmed and a deposit has been paid, the deposit cannot be refunded in the event of cancellation, change of mind, delay in project timing, incorrect quantity calculations provided by the customer, or any other reason not required by Australian Consumer Law.

Nothing in this clause limits any rights or remedies available to customers under the Australian Consumer Law in relation to faulty, defective, or incorrectly supplied goods.

Damaged, Lost or Incorrect Goods

If goods are received damaged, defective, or there is a shortage in the order, Peter Lewis Paints Pty Ltd must be notified within 14 days of delivery.

To process a claim, customers may be required to provide photographs or other reasonable evidence of the damage, defect, or shortage.

Where a valid claim is accepted, replacement goods will be supplied at no additional cost. Claims made after the 14-day notification period may not be accepted.

Product Information, Application & Liability

Customers should carefully read all product labels, technical data sheets, safety information, and application instructions before use. Additional information is available on our website or by contacting our office.

Any information, advice, recommendations, or instructions provided verbally, in writing, online, or through marketing materials are supplied in good faith for guidance purposes only and do not constitute a warranty.

As application methods, substrate conditions, environmental factors, and workmanship are beyond our control, customers remain responsible for determining the suitability of the product for their intended purpose and application method.

To the fullest extent permitted by law, Peter Lewis Paints Pty Ltd shall not be liable for any indirect, incidental, special, or consequential losses arising from the use or performance of its products. This includes, but is not limited to:

·      Labour costs

·      Scaffolding costs

·      Loss of income

·      Project delays

·      Repainting expenses

·      Wasted materials

·      Consequential or indirect losses

Any liability that cannot be excluded by law shall be limited to the replacement of the goods or the value of the goods supplied.

Delivery

Any delivery dates or timeframes provided are estimates only and are not guaranteed.

Time shall not be of the essence in relation to delivery. Peter Lewis Paints Pty Ltd accepts no liability for delays in delivery beyond the value of the goods supplied, except where otherwise required by law.

Governing Law

These Terms & Conditions and any dispute arising from the purchase or supply of goods shall be governed by the laws of Australia and the applicable provisions of the Australian Consumer Law.

Any disputes arising in connection with these Terms & Conditions shall be subject to the exclusive jurisdiction of the courts of Australia.

Changes to Terms & Conditions

We reserve the right to amend these Terms & Conditions at any time. Customers should review the current version each time an order is placed.
